1. Service provided
Keldan provides the subscriber with access to real-time market data in an app and a web solution. The information service comprises access to Icelandic equity and bond information in real time.
2. Subscription
To become a subscriber, the user must purchase a subscription in the application or by contacting Keldan. The subscription is renewed monthly until it is cancelled. The subscription is charged for each month in advance. If the charge fails, the subscription to real-time information will be closed and the user will get access to delayed data.
3. Cancellation of a subscription
Subscriptions are charged at most 24 hours before the start of the next subscription period. To cancel a subscription, this shall be done in the App Store settings for iOS or the Play Store for Android, or by contacting Keldan. A subscription must be cancelled at least 24 hours before the next due date, otherwise the subscription will be charged and is not refundable. Cancellation takes effect the day before the next due date after the cancellation is received. The subscriber's access to Keldan's real-time data is then closed.
4. Refunds
A subscription may be refunded if real-time data does not reach the subscriber because of a defect in the Keldan app.
5. Price
Keldan reserves the right to change prices, and changes shall be notified to the subscriber by email to the email address the subscriber has provided.
6. Assignment of rights and dissemination of information
The subscriber may not assign their subscription to a third party without Keldan's consent. The subscriber may not pass on to a third party information obtained through Keldan's App or web.
7. Classification of subscribers
A subscription to real-time data in the app and on the web is charged according to Kauphöll Íslands' classification of customers. Customers may be considered retail investors or professionals.
By accepting these terms the subscriber confirms their classification.
Under the rules of Kauphöll Íslands, subscribers to real-time access are classified into two categories: retail investors who are not professional investors (non-professionals) and professionals. Under the exchange's rules there is a price difference between the subscription options for professionals and for retail investors. Subscribers must confirm whether they are classified as retail investors or as professionals.
Retail investor who is not a professional:
An individual or legal entity that is not classified as a professional, a professional investor or an eligible counterparty.
Professional, professional investor and/or eligible counterparty:
"A customer who uses market data to carry out a regulated financial service or regulated financial activity or to provide a service for third parties, or who is considered to be a large undertaking, i.e. meeting two of the following size requirements on a company basis: (i) balance sheet total of EUR 20 000 000 (ii) net turnover of EUR 40 000 000 (iii) own funds of EUR 2 000 000."
An individual who works as a professional, e.g. in securities brokerage or investment advice.
If it emerges that a subscriber is classified as a professional, the subscription will be closed and the exchange reserves the right to charge that party according to the professional price list. Subscribers who fall under the professional category may apply for access to KODIAK Pro by sending an email to help@kodi.is.
